Geographical Indication (GI) Act of India:

India enacted Geographical Indication of Goods (Registration and Protection) Act,

1999 to protect the unique products originating from different parts of the country. The Act defines GI as Geographical indication, in relation to goods, means an indication which identifies such goods as agricultural goods, natural goods or manufactured goods as originating, or manufactured in the territory of a country, or a region or locality in that territory, where a given quality, reputation or other characteristic of such goods is essentially attributable to its geographical origin and in case where such goods are manufactured goods one of the activities of either the production or of processing or preparation of the goods concerned takes place in such territory, region or locality, as the case may be”.

 

 The Act stipulates the registration of unique products and producers as follows:

 (i)       Part-A Registration as registered proprietors

(ii)      Part-B Registration as authorized users

The unique textile products, which constitute an important component of the Indian textiles and clothing industry also qualifies for GI registration under the said Act.

The IPR Protection of these products, which bears generational legacy and depicts socio cultural ethos of the country through the GI Act will help in protecting these unique textile and handicraft products of the country from infringement. It will also safeguard the livelihood of the thousands of weavers/artisans associated with the products.
